legal positivism
View of man-made law as it is set (posited) by man for man rather than as it ought to be. It implies that legal rules are valid not because they are rooted in moral or natural law, but because they are enacted by legitimate authority and are accepted by the society as such.I started to argue with my colleague about a new referendum that was passed, and his Legal Positivism attidude really stuck out. He argued that the we must agree with the laws since the voters past it, and the government supports it.
I learned about legal positivism and was surprised at what it actually meant and so was my friend, who asked the teacher about it.
You need to try to use any legal positivism you can in your favor to make sure that you are doing things the right way.
